VivaSpot provides WiFi marketing and automation services to restaurants, hotels, and other hospitality businesses (“Subscribers”). When you connect to WiFi at a Subscriber location or interact with our platform, this Privacy Policy applies to you.

- INFORMATION WE COLLECT
2.1 WiFi Connection Data
When you connect to a WiFi network powered by VivaSpot, we may collect:
- Device MAC address (hashed/pseudonymized for privacy)
- Device type, operating system, and browser information
- Connection timestamps and session duration
- Venue-specific location data (not precise GPS coordinates)
- Network usage statistics
- Captive portal interactions and preferences
2.2 Registration and Marketing Data
When you register on a captive portal or opt in to communications, we may collect:
- Name, email address, and phone number
- Social media profile information (if you use social login)
- Demographic information (age, gender, interests — only if voluntarily provided)
- Marketing preferences and consent records, including SMS opt-in status and timestamps
- Survey responses and feedback

- HOW WE USE YOUR INFORMATION

- Send you promotional emails, offers, and updates on behalf of Subscriber businesses (with your consent)
- Send you SMS/text messages (with your explicit consent — see Section 4)
- Analyze usage patterns and generate anonymized business analytics for Subscribers
- Respond to your inquiries and provide customer support
- Comply with legal obligations
- Enforce our Terms of Use and protect the rights, property, and safety of VivaSpot, our Subscribers, and others

- SMS / TEXT MESSAGING
4.1 Opt-In and Consent
We only send SMS/text messages to individuals who have explicitly opted in. Opt-in occurs when you check an unchecked box on a captive portal or registration form that includes clear disclosure language such as:
“By checking this box, I consent to receive automated marketing text messages from [Business Name] powered by VivaSpot at the mobile number provided. Message frequency may vary. Message and data rates may apply. Reply STOP to cancel. Reply HELP for help.”
Your mobile number will not be used for SMS without this affirmative opt-in action.
4.2 Message Frequency and Rates
Message frequency varies based on your activity and Subscriber promotions. Standard message and data rates may apply.
4.3 How to Opt Out
You may opt out of SMS messages at any time by replying STOP to any message you receive. You will receive a single confirmation message and will not receive further SMS messages unless you opt in again.

4.5 Sharing of SMS Opt-In Data
We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

- HOW WE SHARE YOUR INFORMATION
We may share your information with:
- Subscriber Businesses: The venue whose WiFi you connected to receives customer data (name, email, phone, visit data) to power their marketing programs.
- Service Providers: Third-party vendors who assist us in operating our platform, including email delivery, SMS messaging, analytics, and cloud infrastructure providers. These vendors are contractually prohibited from using your data for their own purposes.
- SMS and Messaging Partners: As described in Section 4.5, we may share your SMS opt-in status with platform providers, phone companies, and delivery vendors solely to facilitate message delivery.
- Legal Requirements: When required by law, subpoena, court order, or to protect the rights and safety of VivaSpot, our users, or the public.
- Business Transfers: In connection with a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction.
We do not sell your personal information to third-party advertisers.

- Customer support records: 3 years
We retain data for as long as necessary to fulfill the purposes described in this policy and to comply with legal obligations.

- SECURITY
